General Terms and Conditions

1. LEGAL RELATIONSHIP

  1. These General Terms and Conditions apply to all orders and purchases-sales, both via the website www.corodo.be and in the showroom, supplied and managed by CORODO BV, registered in the Crossroads Bank for Enterprises under number 0844.358.571, with its registered office at Zandstraat 68, 2400 Mol.
  2. The contractual relationship between CORODO BV and the Buyer (hereinafter ‘Contract’) is governed exclusively by these General Terms and Conditions and the order form/quotation’)

2. CONTRACT

    1. Placing an order implies a payment obligation and the Buyer thus irrevocably and unreservedly confirms to have read, understood and accepted the General Terms and Conditions.
    2. The Contract shall come into effect after CORODO BV has confirmed the order.
    3. CORODO BV reserves the right to refuse an order in case of serious suspicion of abuse of law or bad faith, or if stocks of a particular product have been exhausted.
    4. In the event the Contract is cancelled before the scheduled delivery date, the cancelling party shall be liable to pay fixed compensation to the amount of 20% of the value of the Contract with a minimum of EUR 500.00 if this occurs more than two (2) weeks before the scheduled delivery date and 100% if this occurs later.

    3. DELIVERY

    1. Products are only delivered to countries to which www.corodo.be provides delivery. CORODO BV aims to deliver as quickly as possible. If the delivery address communicated is incorrect, this is the responsibility of the Buyer and may result in additional costs.
    2. The specified delivery times are not binding, but are provided merely as an indication. Delays in delivery and/or performance can never be grounds for a penalty, compensation, termination of the contract or refusal to accept the product.

    4. RIGHT TO CANCEL (only in the case of distance selling)

      1. The Buyer has the right, in the case of a distance sale, to cancel the purchase, without penalty or stating a reason, for fourteen (14) calendar days from the day following delivery of the product.You will find the legal standard form below.
      2. When exercising the right to cancel, the Buyer must return the product to CORODO BV within fourteen (14) calendar days in its original condition, unused*, undamaged, with all the original labels and in the original packaging, in accordance with the return provisions.
      3. CORODO BV undertakes to refund the purchase price of the product (excluding shipping costs) paid by the Buyer within thirty (30) days of receipt of the product, to a bank account number determined by the Buyer.
      4. *In the case of a bicycle, less than one (1) kilometre is sufficient to establish the nature, characteristics and operation, and ten (10) kilometres, respectively, in the case of a scooter. This means that if more than one (1) and ten (10) kilometres have been ridden respectively, the right to cancel lapses and the bicycle and scooter are considered to have been used.
      5. In case of an incorrect return shipment or if the product is a bicycle or scooter on which more than one (1) respectively ten (10) kilometres has been ridden, CORODO BV will not be obliged to pay any amount and the product will remain the property of the Buyer. It can then be collected from CORODO BV within fourteen (14) days or returned at the express request of the Buyer at the Buyer’s expense. In this case, both the risk and cost of returning the product are borne exclusively by the Buyer.

      5. RETURNS

        1. The risks associated with a return shipment shall be borne in full by the Buyer.
        2. Any return shipment must be packaged in accordance with the shipping guidelines (traceable and adequately protected, so the products cannot move freely around inside the packaging), which will be provided to the Buyer by e-mail upon request.
        3. All costs associated with a return shipment shall be borne by the Buyer, except for a return due to damage to the products at the time of delivery or if an incorrect product was delivered. The return shipment costs will then be refunded by CORODO BV and the replacement product will be sent as soon as possible and free of charge.
        4. Subject to legal obligations, CORODO BV will not take back any products whose nature, characteristics or operation have been impaired. This will be assessed by CORODO BV upon receipt of the return shipment.

        6. OWNERSHIP-RISK

          1. CORODO BV remains the owner of the products sold until it receives payment for them in full. In contrast, the risk relating to the products is transferred at the time of sale.
          2. Any transport or shipping shall be at the full cost and risk of the Buyer.
          3. CORODO BV shall have a right of retention in respect of the products in its possession vis-à-vis any person requesting delivery thereof and such products shall further serve as security for the benefit of CORODO BV for all claims against the Buyer.

          7. NO EXCHANGES

            1. Purchased products will not be exchanged or taken back and may not be returned or exchanged without the written consent of CORODO BV, except for any applicable right to cancel as provided for in Article 4.

            8. PRICES AND PAYMENT

              1. Prices include VAT, but exclude other costs such as transport. These costs will be specified separately with the order, and reflected in the total price before the order is placed.
              2. Only the prices at the time of ordering will be applied, except for a manifest error in the price specification. In the latter case, CORODO BV reserves the right to refuse the order and the Buyer has the option of accepting the new price or cancelling the order free of charge.

              9. INVOICE TERMS AND CONDITIONS

                1. Any invoice, the amount of which is not settled or not settled in full on the due date, shall be increased ipso jure by a fixed and irreducible compensation equal to 10% of the amount due, with a minimum of €150.00, without notice of default being required. In addition, interest on arrears shall be due by operation of law.
                2. In the event of a dispute, the Buyer must contest CORODO BV’s invoices by registered letter within thirty (30) calendar days of receipt thereof, at the risk of forfeiting its rights.

                10. FORCE MAJEURE

                  1. In the case of force majeure, which prevents CORODO BV from (continued) fulfilment of the Contract, the delivery and other obligations of CORODO BV shall be suspended. If the period of force majeure lasts longer than eight (8) (consecutive) weeks, both parties are authorised to terminate the agreement without any obligation to pay damages.

                  11. COMPLAINTS, TIME LIMIT FOR COMPLAINTS AND STATUTORY WARRANTY

                    1. CORODO BV guarantees that the products comply with the specifications, features and functions provided to the Buyer.
                    2. CORODO BV shall be liable for any lack of compliance that exists at the time of delivery and that manifest within a period of two (2) years from delivery.
                    3. If the defect occurs after six (6) months from delivery, the Buyer must prove that the defect already existed at the time of delivery.
                    4. The Buyer shall allow CORODO BV, on pain of forfeiture, to carry out a proper examination, which means that the product is brought in (except in case of damage) in a normal condition.
                    5. If, after examination, it is found that the product is defective, the Buyer shall in the first instance opt for it to be repaired and CORODO BV shall, during the warranty period, repair or have repaired all defects at its expense.
                    6. It is important the date of purchase or delivery can be proven to calculate the warranty period. Therefore, it is recommended the Buyer keep the original invoice or a copy thereof.
                    7. The Buyer must notify CORODO BV in writing of any lack of compliance within a period of two (2) months from its discovery, on pain of forfeiting the right to submit a claim for lack of compliance.
                    8. The legal claim shall in any case lapse one year from the day on which the Buyer discovered the lack of compliance, without that period being allowed to expire before the end of the warranty period.

                    12. LIABILITY

                      1. Only if compensation in kind is not possible, the compensation to which CORODO BV may be liable, whatever the cause, nature or object of the claim, shall not exceed fifty (50) percent of the invoice value of the product concerned, except in the case of fraud, intentional error or gross negligence. In the event the Buyer believes it is entitled to such compensation, the Buyer must prove the defects and damages in an adversarial manner.
                      2. However, CORODO BV shall not be held liable for defects or damage caused by normal wear and tear, intentional or unintentional changes made to the product, careless handling or use for purposes for which the product is not intended.

                      13. FINAL TERMS AND CONDITIONS

                        1. The invalidity of one or more provisions of these General Terms and Conditions does not affect the application of the other provisions.
                        2. This contract is governed exclusively by Belgian law.
                        3. Subject to the applicable provisions of consumer law to the contrary, any dispute relating to the conclusion, performance, compliance, validity or any other dispute within the scope of the contract shall be dealt with exclusively by the courts of Hasselt.

                        Standard right to cancel form

                        Dear Customer, you should only complete and return this form if you can and wish to revoke the Contract.
